Applies to: website visitors, prospective clients, and paying clients of our document services (including apostille, notarization coordination, translations, authentications, embassy/consulate legalizations, couriering, and related consulting).
1) Who we are
We provide document preparation, coordination, and courier services to facilitate authentication and acceptance of documents for domestic and international use. We are not a law firm and do not provide legal advice.
2) Acceptance of these terms
By using our website, contacting us, submitting documents, making a payment, signing a service agreement, or authorizing us to begin, you acknowledge you’ve read, understood, and agree to these Terms & Conditions and our Privacy practices below.
3) No refunds & cancellations
All sales are final once the process has started.
- “Process has started” means any of the following has occurred: intake review, document pre-check, drafting, translation, scheduling, notary coordination, courier dispatch, government filing/booking, postage purchase, or any third‑party fee paid on your behalf.
- After this point, no refunds, no chargebacks, and no cancellations are permitted.
- If you cancel before the process starts, we may offer a partial refund at our sole discretion, less any administrative time and non‑refundable third‑party costs.
4) Client responsibilities
You are responsible for:
- Providing accurate, complete, and current information and instructions.
- Supplying original or certified documents that meet the destination authority’s rules.
- Reviewing drafts (translations, affidavits, applications) for accuracy and approving them in a timely manner.
- Paying all service fees, governmental fees, translation costs, shipping, taxes, and any rush or re‑processing fees.
- Keeping copies/duplicates of all documents you send to us.
5) Document handling, shipping & risk of loss
- You understand that all physical shipping carries risk. While we use reputable carriers and reasonable handling, we are not responsible or liable for lost, delayed, misdelivered, or damaged mail or packages handled by USPS, UPS, FedEx, couriers, consulates, embassies, or other third parties.
- Title and risk of loss to your documents transfer to the carrier when we tender the shipment. Any carrier claims (including insurance claims, if purchased) are between you and the carrier.
- You agree to send us copies only when possible and to keep originals safe unless originals are specifically required.
- If a government office, school, employer, agency, or consulate loses or misplaces documents while in their custody, this is outside our control and liability.
- We may recommend insured or trackable shipping, but purchasing insurance is your responsibility unless explicitly included in writing.
6) Processing times & outcomes
- Timeframes are estimates, not guarantees. Government backlogs, holidays, agency closures, staffing, policy changes, weather, strikes, and force majeure events can cause delays.
- We do not control and are not responsible for decisions by government agencies, secretaries of state, the U.S. Department of State, embassies/consulates, schools, courts, or notaries.
- Applications may be rejected for reasons beyond our control (e.g., outdated records, improper seals, mismatched names/dates, damaged documents, destination‑country rule changes). Fees remain earned for work performed and costs incurred.
7) Corrections & re‑processing
- If an error is solely due to our workmanship (e.g., a typo we introduced), we will make reasonable corrections at no additional service fee.
- If re‑processing is required due to client‑supplied errors, late changes, or third‑party/government requirements, new fees and costs will apply.
8) Payments, chargebacks & collections
- Payment is due prior to commencement unless otherwise agreed in writing.
- You authorize us to pay necessary third‑party fees (e.g., government filing, shipping, notary, translation, legalizations) using your funds.
- Chargebacks are prohibited for services rendered or initiated. Unresolved chargebacks may be referred to collections and could include recovery of fees, interest, and reasonable attorneys’ fees.
9) Privacy notice (what we collect & why)
We collect only what we need to provide our services and to operate our business, such as:
- Identifiers & contact info: name, address, email, phone, IP address.
- Document data: certificates, IDs, applications, translations, signatures, seals, and related metadata.
- Payment data: processed via PCI‑compliant processors (we do not store full card numbers).
- Usage data: pages visited, device/browser, timestamps, for security and site performance.
Purposes: intake and verification, service provision, order updates, fraud prevention, recordkeeping, legal compliance, and customer support.
10) Data security (and important disclaimer)
We use reasonable administrative, technical, and physical safeguards to protect information (e.g., access controls, encrypted transmission/storage where feasible, least‑privilege practices).
However, no method of transmission or storage is 100% secure. By using our services, you acknowledge and accept the inherent risks of electronic communications and data handling, including risks from email, portals, cloud storage, carriers, and third‑party vendors.
Leaked data disclaimer: Despite reasonable safeguards, we are not responsible or liable for any unauthorized access, interception, breach, leak, or disclosure of information by third parties (including carriers, email providers, cloud services, government agencies, or malicious actors) that is beyond our reasonable control.
11) Information sharing
We may share your information with:
- Service partners strictly as needed to perform your request (notaries, translators, couriers, agencies, embassies/consulates, payment processors).
- Government agencies to file/verify documents.
- Professional advisors and service providers (IT, security, accountants) under confidentiality duties.
- Law enforcement or regulators where legally required. We do not sell your personal information.
12) Your choices & rights (including California residents)
- You may request access to, correction of, or deletion of your data, subject to legal retention requirements.
- California residents may request a description of data categories collected/disclosed and exercise rights under applicable state privacy laws.
- To exercise rights, contact us (see “Contact us” below). We will verify your identity before acting on requests.
13) Data retention
We retain records only as long as necessary for service delivery, legal/regulatory obligations, dispute resolution, tax/audit requirements, and legitimate business purposes. We may anonymize data for analytics.
14) Communications consent
You consent to receive communications by email, SMS, phone, client portal, or mail related to your order. Standard carrier rates may apply. You can opt out of marketing emails anytime; service/transactional notices may still be required.
15) Electronic signatures & records
You agree that electronic signatures, approvals, and records (including email confirmations and portal clicks) are valid and enforceable as originals.
16) No legal advice
We are not attorneys and do not provide legal advice. Any informational materials are for general guidance only. For legal questions, consult a licensed attorney.
17) Third‑party websites & links
Our website may link to third‑party sites. We are not responsible for their content, privacy, or security practices. Review their policies before providing information.
18) Intellectual property
Our site content, text, logos, and materials are protected by intellectual property laws. You may not copy, distribute, or use our materials without written permission.
19) Limitation of liability
To the maximum extent permitted by law:
- We are not responsible or liable for lost documents or leaked data, delays, rejections, missed deadlines, consequential or incidental damages, lost profits, loss of chance, or indirect losses.
- Our total liability for any claim related to our services shall not exceed the amount you paid us for the specific service at issue.
20) Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms, (b) your instructions or materials, (c) your misuse of our services, or (d) disputes caused by inaccuracies or omissions in documents or information you provided.
21) Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, wars, strikes, pandemics, government actions, system outages, or carrier disruptions.
22) Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to conflict‑of‑law principles.
Dispute resolution: Before filing a claim, both parties agree to try in good faith to resolve disputes informally within 30 days. If unresolved, disputes will be settled by binding arbitration in Orange County, California, under the rules of a recognized arbitration provider. Each party bears its own costs; the arbitrator may award fees as permitted by law. You waive class actions and agree to individual claims only. Small‑claims court remains available.
23) Severability & non‑waiver
If any provision is found unenforceable, the remaining terms remain in effect. Our failure to enforce any right is not a waiver.
24) Changes to these terms
We may update these Terms & our Privacy practices at any time. Changes are effective when posted with the “Last updated” date above. Continued use constitutes acceptance.
